Free legal profession test

Since the entry into force of Law 34/2006, of October 30, on access to the professions of Lawyer and Court Attorney[1] and the approval of its regulations under Royal Decree 775/2011, of June 3, approving the Regulations of Law 34/2006, of October 30, on access to the professions of Lawyer and Court Attorney,[2] the system of access to the legal profession was modified.

The access test was developed with the Resolution of September 7, 2012, of the General Directorate of Relations with the Administration of Justice[3], which established the entire content of the test.

Another controversy arose over the location and language of the tests. Initially, the exam could only be taken in Madrid and in Spanish. Residents who lived far away and/or who studied legal training in one of the co-official languages complained, so other venues were made available to take the tests.[8][9][10] Due to the high percentage of people who took the exams in Madrid, it was not possible to take the exams in Spanish.

Due to the high percentage of people who sit[10][11] and pass the exam (in the March 2018 call, 77.6% of the applicants passed the exam, but 97.3% were eligible to practice, given that it is a weighted score), the bar filed several complaints and is currently negotiating a new, tougher access test with the Ministry of Justice. The new model of the bar exam being negotiated will also unite the access to the bar and to the legal profession (being the same for both professions)[12].

The new model of exam for access to the legal profession that the sector is fighting for and that is already being negotiated with Justice would include an oral practical test before a court of a specific area of law chosen by the student, the elimination of the average between the exam and the master’s degree, making it compulsory to pass the test to obtain the degree and awarding a final numerical grade to the applicant.

For Carlos Fuentenebro, dean of the Bar Association of Bizkaia and president of the Training Commission of the Bar, the essential thing is to have a model “in line with the European Union, not in difficulty, but in seriousness”, in order to avoid the plague of Italian and Romanian citizens who use our model as a shortcut to practice in their country. Specifically, it has been negotiating since the end of 2017 with the Ministry of Justice the reform of the exam because they consider that today “it is not relevant and sufficient” to demonstrate that applicants have acquired the knowledge and skills required to be a lawyer. “We want to enhance everything practical and that it is accredited that they have acquired that knowledge as the Law and the Regulations say, since we believe that it does not meet the necessary standards for it,” he admits.

Due to this excessive offer, Law 34/2006, of October 30, on Access to the Professions of Lawyer and Attorney of the Courts has intended to increase the difficulty to become a practicing lawyer. Thus, it requires the prior approval of a Master’s Degree for access to the legal profession. Supposedly, the Master’s Degree and the subsequent entrance exam should result in fewer, but better trained lawyers. However, the Master’s degree is no more difficult than the Bachelor’s degree. To date, the exam has had a pass rate of over 90%.
