Thus, on the one hand, Organic Law 16/1994, of November 8, 1994, reforming Organic Law 6/1985, of July 1, 1985, of the Judiciary, introduced, for the first time in our legal system, the possibility of using technical, electronic and computerized means for the development of the activity and the exercise of the functions of courts and tribunals. The reform included the possibility of providing the new documents or communications with the validity and effectiveness of the originals, provided that the authenticity, integrity and compliance with the requirements set forth in the procedural laws were guaranteed.

Since this reform, numerous amendments have been made to different rules in order to give effect to this provision. It should be noted, however, that these modifications have been made in response to specific and specific needs detected almost always in the different procedural laws. ABSTRACT: News reports on pending litigation seem to be protected in two ways: by the principle of public judicial proceedings, and by freedom of/right to information. In procedural matters, both appear to refer to the same object, and even to be coincident. But the distinction and differential treatment of both rights remains relevant and necessary, since one seeks to protect the integrity of the process, while the other seeks to contribute to the formation of public opinion on matters of general interest. Also, it is relevant when it becomes necessary to restrict or regulate practical situations, performing the analysis from one perspective or the other.

In the permanent and often harsh debates concerning the publicity given by the media to judicial proceedings, as well as the actions of facilitation of such information offered by the different participants in the process, two fundamental rights are usually mentioned to argue in favor of the legitimacy of the dissemination: procedural publicity and freedom of expression (especially in its aspects of freedom to inform and the right to receive information).

Circular 41/2020 judicial branch of the state of mexico

It is necessary to establish a system for the management and custody of judicial documentation by which the different courts and tribunals are decongested, giving each one of them its own archive with which to classify and keep custody of all those files that are being processed. On the other hand, those that are not pending processing can be sent to the territorial or central archives or, as the case may be, to the Expungement Board, thus preventing them from occupying unnecessary space. This requires an updating and unification of the regulations governing the expurgation of the archives of the courts and tribunals, as well as the establishment of criteria that guarantee the most suitable conservation of any documents that may have cultural, historical, legal or administrative value, since it must not be forgotten that the documentation produced by the Administration of Justice constitutes an integral part of the Documentary and Bibliographic Heritage.

This Royal Decree aims at the unitary and joint regulation of this matter, adapting it to the current social and legal reality, achieving a balance between the traditional archival technique and the growing development of new technologies.
