How does probation work in Arkansas?

Most people probably think that incarceration rates and crime rates run in tandem, but the crime rate in Arkansas and the country as a whole has been on the decline since the early 1990s.

The solution in Arkansas and elsewhere was to place prisons or prisoners under the control of private contractors. In 1880, under private supervision, 20% of state inmates died. A committee of the Arkansas House of Representatives called “the contract system cruel, barbarous and inhuman and wholly at variance with the civilization of the times,” but, “because of the present disgraceful financial condition of the State” made no recommendation for a change.

The private contractor system remained in Arkansas until 1913, but conditions did not improve. A state House committee in 1941 reported that prisoners were beaten and tortured, inadequately clothed and served almost inedible food, but no steps were taken to improve conditions.

Art. 13 of the Criminal Code: interpretation. Reports prepared by experts and administrative bodies: non-binding nature. premises for their correct assessment. Omission to indicate the type of treatment provided to the inmate. Absence of adequate reasoning, based on objective and factually correct circumstances. Revocation of the sentence that decided to confirm the order that did not grant the benefit of parole. The immediate release of the accused is ordered.

“The decision by which the enforcement judge denied the requested conditional release and decreed the nullity of the conduct and favorable report issued by the Prison Service must be annulled, since the court did not provide the reasons why it considered that the disciplinary sanction imposed on the convicted person -in this case, possession of a cell phone- was decisive for the purpose of denying conditional release”.

“In view of the fact that the conduct and concept ratings prepared by the Correctional Council are inconsistent with the disciplinary offenses committed by the convicted person and punished in due time, said body should be required to provide the corresponding explanations. Parole Board

The state trial court sentenced him to life imprisonment without the possibility of parole. Jackson filed a state habeas corpus action alleging that this sentence violated the Eighth Amendment to the U.S. Constitution. In a split decision, the court granted the State of Arkansas’ motion to dismiss this claim. The Arkansas Supreme Court affirmed this decision.

In case 10-9646, Miller and a friend beat a neighbor and set his trailer on fire after spending a night consuming alcohol and drugs. The neighbor subsequently died. Miller was initially charged as a juvenile, but his case was transferred to adult court before which he was charged with manslaughter by arson. The jury found him guilty and the trial court sentenced him to life imprisonment without the possibility of parole.
